ENTER THE 93013 PHOTO CONTEST BY MIDNIGHT October 5, 2015

Amateur and professional photographers of all ages are invited to enter their best images celebrating our community in the 93013 Photo Contest between September 8 and midnight October 5th. CRITERIA: The goal of this competition is capturing significant moments that evoke the feel and mood of Carpinteria, California and the newly opened Franklin Trail. Images will be shared with community members via an online gallery and at an awards ceremony and reception on October 17th, 2015. Judging in October is by arts and photography professionals and community leaders who will select images that best depict Carpinteria in five categories (see below). The public is invited to vote on-line between September 8 and midnight October 13th for the People's Choice awards. All participants are invited to a Reception and exhibit of winners on October 17th, 2015 and all entries are eligible to be featured in Santa Barbara County Trails Council's publications of print and electronic media with photo credit.

CATEGORIES: Capture Carpinteria's beautiful outdoor environment, active people and vibrant community life, and submit your favorite photographs in these categories:

IMAGE REQUIREMENTS: Eligible images from a digital camera set at no less than 3 mega pixels high resolution or digitally scanned if from a non-digital camera must be in either JPG or PNG digital format at a file size of between 3 megabytes (minimum) and 9 megabytes (maximum) at 300 dpi (dots per inch) of sufficient resolution to print at 8 by 10 inch size without a loss of quality. Sufficient resolution to print at 16 by 20 inch size without a loss of quality is preferred.

For each entry the contestant MUST supply all the following information:

By submitting entries, the contestant acknowledges and agrees to the terms of the contest ENTRY AGREEMENT (read terms below).

ENTRY AGREEMENT

In submitting the attached photo(s) (PHOTO) to the Santa Barbara County Trails Council (Trails Council) and participating in the Santa Barbara County Trails Council Photo Contest I (we), (CONTESTANT), hereby warrant and agree to the following:

CONTESTANT warrants to Trails Council that he/she has lawful ownership rights to the PHOTO and acknowledges that once submitted, some rights to the PHOTO becomes the property of the Santa Barbara County Trails Council.

The PHOTO is the result of CONTESTANT'S sole artistic efforts unless otherwise stated above as a collaboration.

Except as otherwise disclosed in writing to the Trails Council in this online submittal form, the PHOTO is unique and original and does not infringe upon any copyright or patent.

The PHOTO is free and clear of any lien. Except for title and possession, pursuant to the Copyright Act of 1976 (17 U.S.C. §101 et seq.), CONTESTANT will retain the copyright and all other rights in and to the PHOTO. The CONTESTANT grants to Trails Council an irrevocable and non-exclusive worldwide license to reproduce, to distribute, and/or to display two- or three-dimensional reproductions of the PHOTO in any manner whatsoever relating to any Trails Council publication or event, including, without limitation:

Public display as well as reproduction on Trails Council items, such as print ads, postcards, posters, brochures, applications, television programs and the Trails Council website.

In addition the Trails Council will include CONTESTANT'S name somewhere on the document where the photo is used.

The Trails Council may alter images of the PHOTO as necessary to fit into reduced or enlarged format sizes.

The Trails Council may use the PHOTO on Trails Council merchandise and commercial items which may be provided for fundraising and recognition purposes.

Winners are responsible for all federal, state and local taxes, if any. All federal, state and local laws apply. Contests and promotions are void where prohibited or restricted by law.

There are no prize substitutions. Prizes are non-transferable and are not negotiable. Prizes can not be exchanged for cash. Sponsors and the Trail Council reserve the right to substitute prizes of equal or greater value.

Some prizes have restrictions, or expiration dates, and do not include gratuities. If the winner is not able or chooses not to accept prize "as is," the winner forfeits his or her prize. The winner is responsible for all costs associated with travel to any venue or event for which a prize is awarded, unless otherwise specified.

Odds of winning are undeterminable and depend on varying internet access and/or the volume of entities received.

Winners that live within Santa Barbara County must pick-up their prize in person at 650 Ash Avenue, Carpinteria, California 93013, unless arrangements are made in writing. Prizes for winners living outside of Santa Barbara County will be mailed or sent by UPS.

Trails Council is not responsible for any prize lost or damaged in shipping. Any prize not picked-up or otherwise claimed within 30 days will be forfeited.

All contestants and winners acknowledge as a condition of entry that Trails Council, all organizations providing prizes and their participating sponsors have the right to publicize and broadcast his/her name, character, likeness and voice on the air in print advertising.

Winners of a prize with a value of $500.00 or more will be required to complete IRS Form W-9 and will be issued IRS Form 1099 at the time the prize is claimed.

Trails Council reserves the right to modify these general rules at any time provided the modified results are announced and made available to the public. Copies of these rules are available at 650 Ash Avenue, Carpinteria, CA 93013. Trails Council reserves the right to cancel a contest or promotion at any time prior to the selection of a winner. All decisions of Trails Council with regard to the awarding of prizes, the selection of winners and the interpretation of contest or promotion rules shall be final. Each contestant by virtue of entering a contest or promotion agrees to accept the decision of Trails Council as final.

Trails Council makes no warranty of any kind with respect to prizes, including, but not limited to, any warranties or merchantability or fitness for a particular purpose.

Trails Council hereby expressly disclaims any such warranties.

By participating, all entrants acknowledge and agree they have entered the contest or promotion of their own free will, that the full rules and details of the contest or promotion have been made available to them in writing and they therefore understand and agree that neither Trails Council, all organizations providing prizes, their agencies, and their immediate families, or their agents, affiliates, sponsors, representatives or employees have limited liability with respect to contestants' participation in the contest or promotion or winning a prize and are not liable for any damages arising from acceptance and use of a prize, including liability for personal injury and/or death. By entering into a contest or promotion, participants agree to be bound by these rules and the decision of Trails Council, which are binding in all respects.

When claiming a prize, the winner must sign a form (i) acknowledging they have read the rules relating to the specific contest or promotion associated with the prize and (ii) releasing Trails Council and any sponsors of the contest or promotion, and their respective officers, directors, agents, parent companies, subsidiaries and employees, from all claims, demands and or/or causes of action of any nature or kind whatsoever, whether presently known or unknown, foreseen or unforeseen, that he/she may have, or that he/she may subsequently acquire, as a result of his/her participation in the contest or promotion and/or receipt of the prize.

Trails Council is not responsible illegible, late, lost or misdirected entries or for telecommunications malfunction including, but not limited to, any malfunction caused by or through any local or national telephone service provider, cellular telephone provider or internet access provider.

If any of these rules is determined to be unenforceable under an ordinance or statute, all other provisions and rules shall remain in full force and effect.

Pursuant to 17 U.S.C. § 106A(3) and only to the extent that this Agreement differs, CONTESTANT expressly waives any rights that the he/she may have under Cal. Civ. Code § 987 or 17 U.S.C. §§ 101 et seq., including, without limitation, 17 U.S.C. §§ 106, 106A, and 113, or any successor statute(s) or regulation(s).

HOLD HARMLESS

CONTESTANT agrees to release Trails Council, its agents, officials, employees, and volunteers from and against all liability, including copyright or patent infringement claims or causes of action, arising out of this Agreement and claims arising from CONTESTANT'S participation in the 93013 Photo Contest. CONTESTANT agrees to defend (with counsel satisfactory to Trails Council), indemnify and hold Trails Council harmless and free from all liability, whether caused by passive negligence or otherwise, arising out of CONTESTANT'S participation or association with the 93013 Photo Contest. CONTESTANT agrees to pay all costs incident to any claim, including, without limitation, attorneys' fees. I agree that the above information is correct. I further agree that this agreement is intended to be as broad and inclusive as is permitted by the law of the State of California.
